The American Law Institute (Philadelphia, PA) has published
Restatement of the Law Third) Property (Servitudes), a two--volume set
that supercedes the original Restatement published in 1944. The ALI said
the set simplifies and clarifies the law of covenants, easements and
profits, and provides that: servitudes should be interpreted to carry
out the intents of the parttes; they allow flexibility for adapting to
changes; they remove obstacles to "innovative" development
practices; they allow modification and termination of obsolete
servitudes; and, they protect conservation and historic-preservation
servitudes. It also covers the law governing residential common-interest
communities, and includes data on black-letter provisions and comments
on background and applicability of those provisions. It costs $195.
