 ZILA FILES DECLARATORY JUDGMENT ACTION
 REGARDING PERIGEL (TM) INFRINGEMENT CLAIM
 PHOENIX, Ariz., June 11 /PRNewswire/ -- Zila Pharmaceuticals, Inc., a subsidiary of Zila, Inc. (NASDAQ: ZILA), announced today that it has filed a declaratory judgment action in federal district court in Phoenix, Ariz., seeking a judicial determination that its PeriGel product does not infringe any valid patent rights held by Block Drug Co. The action was filed in response to correspondence from Block to Zila which asserted that the PeriGel product might infringe patents held by Block.
 Zila President Joseph Hines commented, "After a thorough review of Block's assertions by Zila's patent counsel, we are confident that PeriGel does not infringe any valid patent rights under the Block patents, therefore Zila will not be intimidated into withholding the market introduction of a superior product. Accordingly, Zila is proceeding with the introduction of PeriGel in the Arizona market as scheduled, this month." In the event that it was ultimately determined that any infringement did occur, Zila would be liable to Block for any damages that might result.

According to newly released independent industry sales statistics, Zila has taken the number one position in the state for pharmacy sales of cold sore/canker sore treatment products.  PeriGel is a unique oral care system for teeth and gums. A PeriGel carton contains two tubes -- one a baking soda paste with fluoride, the other a hydrogen peroxide gel. Equal amounts from each tube are applied to the toothbrush. PeriGel delivers the highest approved levels of baking soda and hydrogen peroxide of any combination product.
