WARNER-LAMBERT SEEKS INJUNCTION FOR INFRINGEMENT
OF ITS NOVON PATENTS
MORRIS PLAINS, N.J., May 21 /PRNewswire/ -- Warner-Lambert Company (NYSE: WLA) announced today that it is seeking an injunction against EnviroPack, Inc. (Clean Green Company) of Minneapolis in the U.S. District Court for the District of Minnesota, for infringement of its patents related to the thermal processing of starch and biodegradable starch-polymer blends.
Warner-Lambert's Novon Products Group was granted a patent on the thermal processing of starch in 1988, and its most recent patent, covering thermally processed starch/polymer blends, was granted on March 10, 1992.
According to Philip M. Gross, president of the Novon Products Group, "While we sought to avoid prolonged and costly litigation, Clean Green's recent activities have left us little choice. We have made it very clear that we intend to act aggressively to remove infringing product from the market including pursuing Clean Green for infringement of our proprietary technology."
On April 20, 1992, Clean Green filed a declaratory judgement suit in the U.S. District Court for the District of Minnesota, requesting an injunction of Warner-Lambert's claims of patent infringement.
Novon Products discussed this matter extensively with the Clean Green Company for three months prior to the suit but was unable to reach a business arrangement.
Gross also stated that Warner-Lambert will use every available option to defend its exclusive technology from other companies that infringe to insure that Warner-Lambert stockholders' investment is protected and rewarded.
