United Kingdom : Interim Manager appointed to the Park Charitable Trust.

The Charity Commission, the independent regulator of charities in England and Wales, has appointed an Interim Manager to The Park Charitable Trust, registered charity number 1095541.

On 16 August 2016 the commission used its powers under section 76 of the Charities Act 2011 to appoint Ian Oakley-Smith of PricewaterhouseCoopers as Interim Manager of the charity. The Interim Manager will have all the powers and duties of the trustees and the appointment is to the exclusion of the trustees. This appointment is a temporary and protective measure and will be reviewed by the commission on a regular basis in line with normal procedures.

The Interim Manager is tasked with taking over the management and administration of the charity on a temporary basis. In addition to taking control of and protecting the charitys assets the Interim Manager is tasked with conducting a review, which will include, but is not limited to:

the charitys investments

establishing the assets, liabilities and creditors of the charity

the past governance of the charity and the composition of the trustee board; examining whether conflicts of interests and loyalty arising from the trustees interests in other companies, other trusteeships and their family relationships were identified and managed by them

The review will also examine whether there has been (and if so to what extent) any breach of duty and/or trust by the charity trustees in relation to the operation of the charity, and what steps may be necessary and in the best interests of the charity in response to any breaches of duty and/or trust.

The trustees have informed the commission that they intend to wind up the charity. To ensure that this action is completed in a transparent and open manner and by a non-conflicted person, the scope of the appointment also includes completing the dissolution of the charity.
