UNITED STATES SURGICAL CORPORATION GRANTED PRELIMINARY INJUNCTION AGAINST ORIGIN MEDSYSTEMS, A SUBSIDIARY OF ELI LILLY

 NORWALK, Conn., Jan. 13 /PRNewswire/ -- Leon C. Hirsch, chairman of United States Surgical Corporation (NYSE: USS), announced today, "that on Jan. 12, U.S. District Judge Vaughn Walker, Northern District of California, granted USS' request for a preliminary injunction and ordered Origin Medsystems, Inc., a subsidiary of Eli Lilly & Co. (NYSE: LLY), to cease immediately making, using or selling their trocars, which removes the product from the market."
 Judge Walker found USS' patent valid and infringed, that Origin misappropriated the basic technology from which their trocar was developed.
 Leon Hirsch stated, "This injunction should send a clear message to all companies seeking to enter the endoscopic market that they must respect the patent rights of USS, and that if they want to develop endoscopic products they better develop their own technology, not copy ours."
