 U.S. MARSHALS SEIZE TREATED SCALLOPS
 BOSTON, Dec. 19 /PRNewswire/ -- United States Attorney Wayne A. Budd


announced yesterday that Deputy United States Marshals for the District of Massachusetts have seized approximately 1,600 pounds of decomposed and mislabelled scallops with an estimated value (if fresh) of $4,800. The scallops, which were labeled in part "IQF SEA SCALLOPS... 6x5 LB. MAR-LEES SEAFOOD, INC.... New Bedford, MA," had been treated with sodium tripolyphosphate. While such treatment is not in itself illegal, the label must indicate that the scallops have been treated. It is believed by some that sodium tripolyphosphate is used to cause scallops to absorb water, thereby increasing their weight and bringing a higher price. At a minimum, according to Budd, the consumer has the right to know that the scallops have been treated. In addition, according to the complaint filed by the United States Attorney's Office, the scallops were decomposed and unfit for consumption within the meaning of the Federal Food, Drug and Cosmetic Act.
 This case was investigated by the United States Food and Drug Administration and is being handled by Assistant U.S. Attorney Thomas E. Kanwit, of Budd's Civil Enforcement and Defense Bureau.
