U.S. JUDGE RULES IN FAVOR OF ROADWAY EXPRESS IN ANTITRUST LAWSUIT
AKRON, Ohio, Oct. 30 /PRNewswire/ -- Roadway Services, Inc. (NASDAQ: ROAD) announced today that a United States District Court in South Carolina has entered a judgment in favor of the defendants -- Roadway Express, Consolidated Freightways and Yellow Freight -- in the five and one-half year old antitrust lawsuit filed by Lifschultz Fast Freight.
"We are gratified by the decision," said Joseph M. Clapp, chairman and president of Roadway Services, the parent of Roadway Express. "As the decision clearly demonstrates, there was never any basis in fact or law to support the plaintiff's claims.
"Despite the length of the proceedings and the publicity campaign waged by Lifschultz, the claim of an antitrust conspiracy among these three defendants has always been, in the words of the judge, 'preposterous'," he added.
The case, filed in March 1987, alleged that the defendant companies had been engaged in a conspiracy for over 15 years to drive rivals out of the less-than-truckload (LTL) market. That claim, as well as a related RICO charge, has been dismissed by the Court as being completely without foundation.
Clapp stated that Roadway Express has always abided by the antitrust laws and continues its policy of strict adherence to their requirements.
