U.S. DISTRICT COURT DISMISSES SHAREHOLDER LAWSUIT FILED AGAINST nVIEW CORPORATION AT?WO CORPORATE OFFICERS

NEWPORT NEWS, Va., Aug. 17 /PRNewswire/ -- nVIEW Corporation (NASDAQ-NMS: NVUE) announced today that an amended complaint against the company and two of its officers was dismissed by the U.S. District Court for the Eastern District of Virginia, Newport News Division, in an opinion filed Aug. 13, 1993. The company was informed of the dismissal and received a copy of the ruling on Aug. 16, 1993.
On April 7, 1993, the court dismissed the plaintiffs' initial complaint filed on Aug. 18, 1992, ruling that the plaintiffs had failed to state a claim on two counts of the complaint and, on a third count, had failed to meet the requirements of Rule 9(b) of the Federal Rules of Civil Procedure. On the third count, however, the court granted the plaintiffs leave to amend. The plaintiffs filed an amended complaint on April 22, 1993.
In dismissing the amended complaint, the court ruled that the amended complaint failed to meet the pleading requirements of Rule 9(b) and that it also failed to state a claim upon which relief may be granted under Rule 12(b)(6) of the Federal Rules of Civil Procedure. The court did not grant the plaintiffs leave to further amend their complaint. The plaintiffs have 30 days in which to appeal the court's order.
