U.S. COURT OF APPEALS UPHOLDS INJUNCTION AGAINST ROPAK IN PERSTORP XYTEC PATENT INFRINGEMENT LAWSUIT

U.S. COURT OF APPEALS UPHOLDS INJUNCTION AGAINST ROPAK
IN PERSTORP XYTEC PATENT INFRINGEMENT LAWSUIT
TACOMA, Wash., Jan. 24 /PRNewswire/ -- Perstorp Xytec, Inc., announced today that a ruling by the U.S. Court of Appeals in Washington, D.C., on Jan. 14 upheld an earlier lower court ruling (Feb. 15, 1991) granting Xytec, Inc. (the company's former name), a preliminary injunction restraining Ropak Corp., Fullerton, Calif., from manfacturing, distributing and selling its Mainstream 4000 Series and Delta bins.
Previously, a strongly worded order issued in federal District Court, Detroit, Judge Julian A. Cook Jr., had agreed with Xytec's claim that Ropak infringed upon Xytec's patent, trademarks and trade dress licenses covering a collaspible plastic shipping bin. Citing the potential for bankruptcy from the impact of the injunction, Ropak was granted a stay pending the outcome of an appeal. That stay has now been reversed by the U.S. Court of Appeals ruling.
Spencer Hoopes, Perstorp Xytec president and CEO, said, "We are extremely pleased and relieved with the appeals ruling. It has been a long and expensive struggle, and we now hope that the case can be resolved expeditiously."
Hoopes also stated that the appeals ruling vindicates Perstorp Xytec's position of strongly defending the company's patent rights and that other companies violating Xytec's patent rights will be pursued more vigorously in the near future.
Perstorp Xytec is the new name of the company resulting from its acquisition by Perstorp A.B., of Sweden, in May of 1991. The company, based in Tacoma, is the leading manufacturer of large returnable/ collapsible plastic shipping containers for the material handling industry, and pioneered this container design during the 1970s and 80s. Additionally, Perstorp Xytec now markets Perstorp products in the United States and is a leading supplier of medical material handling systems (marketed under the name of Unicell) and custom material handling products.
