Tsingtao, Monarch settle yet another trademark dispute

The Qingdao Brewery and Monarch Import Co. have announced that a settlement has been reached in the trademark infringement and unfair competition lawsuit brought against Western Worldwide Enterprises Group Corp. (WWE), Frank Yen, and certain WWE distributors.

The settlement now prohibits the defendants from using the trademark "Tsingtao" in the United States in connection with malt beverage products, and also requires the destruction of any remaining inventories of the infringing products.

According to the Monarch Import Co., the lawsuit came about because WWE was "importing infringing products such as Tsingtao Light, Dark, Dry and Gold into the U.S. which were not produced by the Qingdao Brewery."

"We're very happy that the integrity of the Tsingtao trademark - the most widely recognized Chinese trademark in the United States - has been fully protected at this point," reported Glen Steinman, Monarch Import Co.'s vice president.

"It was because of the close cooperative efforts among the Qingdao Brewery, Monarch Import Co., Barton Beers Ltd., the China Council for the Promotion of International Trade and the China National Cereals, Oils and Foodstuffs Import and Export Corporation, that this settlement came to be."

In October, Monarch announced that a similar agreement with Sharimalia Food Corp. had been reached. The two sides were in dispute over the similar names of their products. While Monarch's Tsingtao is brewed by the Qingdao Brewery in China, Sharimalia owns the Tsingchuen brand, which is produced by China's Qindao Brewery.

Under the previous areement, Tsingchuen's packaging would be changed to assure that the two parties' products will not be confused by consumers.
