 TRUSTEE TO PURSUE ASK CORPORATION CLAIMS
 WACO, Texas, July 24 /PRNewswire/ -- Special counsel for Randolph


Osherow has filed a motion with the U.S. Bankruptcy Court asking that Osherow be substituted as the plaintiff against former ASK Trustee, Stanley W. Wright, the Austin law firm of Overstreet, Winn & Edwards, P.C. and the Waco law firms of Pakis, Giotes, Beard & Page, P.C. and Cherry, Davis, Harrison, Montez, Williams & Baird, P.C.
 ASK President Brian D. Pardo filed suit against the former trustee and the law firms on Feb. 28, 1992, claiming damages for the negligent loss of technological property of the ASK estate. Pardo sought to recover $11,182,000 in actual damages and $20,600,000 in punitive damages on behalf of ASK's creditors and shareholders.
 In the trustee's motion for substitution as plaintiff the trustee stated (in the supporting brief) "although no formal discovery has been conducted, extensive legal research and factual investigation now has been completed and the trustee has determined that -- except for the matter of the RICO claim -- there is evidence and legal precedent to support the complaint."
 The trustee adopted Pardo's claims of fraud and misrepresentation, and breach of fiduciary duty and gross negligence, including claims against the bonding company for the former trustee, but disavowed the RICO claims Pardo had asserted.
 Pardo said he would not oppose the motion. "I am satisfied that the trustee will pursue these claims through to a successful conclusion," Pardo said.
 Presiding U.S. Bankruptcy Judge Frank Monroe has consolidated this suit with another suit brought by a secured creditor of ASK against the former trustee for $7.2 million in actual and punitive damages.
 Pardo said he would continue to assist the estate under court authorization to prosecute patent infringements that have sprung up since ASK Corporation filed bankruptcy.
