 TORO'S TRADEMARK CLAIMS AGAINST SNAPPER DISMISSED BY AGREEMENT
 ATLANTA, April 28 /PRNewswire/ -- The Toro Company (NYSE: TTC) and the Snapper Division of Fuqua Industries, Inc. (NYSE: FQA) today issued a joint statement announcing the dismissal of the trademark infringement and unfair competition claims in a lawsuit filed by Toro against Snapper.
 In the lawsuit, Toro alleged that Snapper's use of the words "recycle" and "recycling" in connection with the advertising and sale of Snapper lawn care products constituted trademark infringement and unfair competition. Toro and Snapper said today that the trademark infringement and unfair competition claims in the lawsuit have been dismissed by agreement.
 Under the terms of the agreement, Toro agreed that Snapper may continue to use the words "recycle" and "recycling," and variations of the word "recycle" (except "Recycler," a trademark of Toro) to describe Snapper lawn care products and the functions of such products, but not as trademarks. Snapper agreed, consistent with its past practice, not to use the word "recycler" as a trademark or to describe any of its lawn care products. It also agreed not to contest Toro's right to use or register "Recycler" as a trademark.
 The lawsuit also involves patent issues which are the subject of continuing discussion between Toro and Snapper.
