TEKTRONIX, FERGASON AND MORGENTHALER SETTLE INFRINGEMENT SUIT

WILSONVILLE, Ore., Feb. 4 /PRNewswire/ -- Tektronix Inc. (NYSE: TEK) and James L. Fergason, a liquid crystal scientist, and his partner, Todd W. Morgenthaler, jointly announced today that they have reached an amicable settlement of their pending lawsuit, according to Tektronix. Fergason and Morgenthaler charged Tektronix in the suit with infringement of certain of their jointly owned patents in the field of liquid crystal technology. On Dec. 14, 1992, a jury in the U.S. District Court for the Northern District of Ohio found against Tektronix on the infringement claims and awarded the plaintiffs approximately $5 million in damages and interest.
While the financial terms of the settlement were not disclosed, the settlement provides that all past infringement claims are released and Tektronix will have a license, applicable to itself, its customers and its licensees, under the Fergason patents in the liquid crystal display field.
"This settlement permits the parties to pursue their respective business activities rather than spend further time, energy and money on litigation," said Jerome J. Meyer, chairman and chief executive officer of Tektronix. "We think this is in the best interests of both parties." Tektronix indicated that the settlement would not have a material adverse impact on its financial position or results of operations.
Fergason commented, "Tektronix and I are pleased that the litigation is over, and we can go on with our businesses."
