TAMPA JURY AWARDS $3 MILLION TO SANFORD COUPLE IN ASBESTOS
SUIT AGAINST W.R. GRACE & COMPANY AND OWENS-CORNING
TAMPA, Fla., Oct. 5 /PRNewswire/ -- A retired Sanford construction worker and his wife have been awarded a total of $3 million by a jury in Hillsborough County Circuit Court for damages resulting from exposure to asbestos.
Arthur Dougherty, 65, suffers from mesothelioma, a form of cancer which strikes the lining of the lungs. He was awarded $2 million and his wife, Joan, was awarded $1 million following a one-week trial.
The defendants in the case were W.R. Grace & Company, based in Boca Raton, and Owens-Corning Fiberglass Corp., based in Toledo, Ohio. The verdict cited both companies for negligence. The plaintiffs were represented by Ervin A. Gonzalez of Robles & Gonzalez, a Miami law firm which represents thousands of asbestos victims across the country.
According to Gonzalez, Dougherty's cancer is a direct result of the worker's exposure to asbestos contained in materials manufactured by the two defendant companies.
"Long after it was known that asbestos had such dreadful side effects, many companies continued with its use simply because it was economical," said Gonzalez. "Hopefully, judgements like this will make companies think twice before they proceed with practices or materials that are harmful to workers."
Gonzalez said Dougherty was exposed to materials containing asbestos which were manufactured by Owens-Corning and W.R. Grace & Company while working at job sites throughout Florida.
"Naturally, we're elated by the results of this case, but there remain many more victims who need to be compensated," Gonzalez said.
The lawsuit was filed earlier this year. Juan Bauta, an associate with Robles & Gonzalez, served as co-counsel on the case, and Jennifer Westfall served as paralegal. The defendants were represented by national trial counsel from Virginia, Alabama, Massachusetts and Florida.
