SUPERIOR COURT RULES IN FAVOR OF MARRIOTT IN MANAGEMENT CONTRACT DISPUTE

SAN DIEGO, May 12 /PRNewswire/ -- A San Diego judge has told Douglas Manchester that he cannot oust Marriott from management of the San Diego Marriott Hotel and Marina.
In a decision issued yesterday afternoon, Judge Harrison Hollywood of the San Diego Superior Court, said Marriott's agency is "coupled with an interest" and not terminable at will. The decision was rendered after hearing three days of testimony last week from the people who negotiated the transaction in 1987 when Marriott took over management of the hotel.
Marriott spokesperson Roger Conner said Manchester has been trying to renegotiate the deal he made in 1987 when Marriott contributed a significant amount of capital to the hotel project at a time when it was experiencing difficulties.
Marriott's counsel Howard A. Allen, of the San Diego law firm of Hillyer & Irwin, told the court "a deal is never a deal with Mr. Manchester."
"We are obviously pleased with the court's ruling," said Marriott's general manager, Ray Warren. "Mr. Manchester has been saying for months that our Management Agreements would be terminated. We have continually assured our customers and employees that Marriott would be here for a long time. Marriott is very proud of its operations in San Diego and we look forward to serving the community for many years."
