STARBUCKS FILES SUIT AGAINST SECOND CUP COFFEE
    VANCOUVER, B.C., Sept. 30 /PRNewswire/ -- Starbucks Coffee Co. (NASDAQ: SBUX) announced it filed a lawsuit today alleging that customers are confused by the similarity of Second Cup stores to Starbucks.
    The Second Cup stores recently adopted logo design, product packaging, menu boards, in-store photographs and coffee shop decor that look similar to Starbucks' designs.  Starbucks alleges that as a result, customers may mistake The Second Cup coffee shops for Starbucks' own. Starbucks' complaints about The Second Cup decor finishes include the similarity of the design of wood stains, paint types and textures.
    Starbucks alleges that The Second Cup Co. has modified some of their stores in the past few months and that these modifications gave rise to the confusion.
    "Over the years we have made a huge investment in building an identity for our company," said Lawrence Maltz, senior vice president for Starbucks.  "We welcome competition from retailers who establish their own identity.  However, Starbucks will call on the courts to stop competition which confuses customers."
    Starbucks Coffee Co. has more than 150 company-owned stores in North America.  The Second Cup Co. has more than 175 company-owned and franchised coffee retail locations in Canada.
