STAAR SURGICAL FILES $30 MILLION ACTION AGAINST ALLERGAN MEDICAL OPTICS VIOLATION OF SHERMAN ANTITRUST ACT ALLEGED

 MONROVIA, Calif., March 18 /PRNewswire/ -- STAAR Surgical Company (NASDAQ: STAA) today filed a lawsuit in the United States District Court against Allergan Medical Optics, Inc. ("AMO") for alleged violations of various antitrust laws, including the Sherman Antitrust Act.
 The suit is based on Allergan's attempt to appropriate STAAR's Bartell patent rights, Allergan's filing of a bad faith lawsuit against STAAR under the guise of an infringement of the Bartell patent, Allergan's sale of its products (IOL) at predatory levels below its costs in certain cases, and Allergan's fraudulent sale to STAAR of unmerchantable IOL material, all in an effort to monopolize the production and sale of foldable IOLs.
 STAAR is seeking $30 million in actual damages. A recovery based on the Sherman Antitrust Act carries with it treble damages as well as the awarding of the costs of suit and reasonable attorney fees.
 The company has retained the services of Maxwell Blecher, Esq., of Blecher & Collins, a major law firm specializing in antitrust litigation, to prosecute this action. Allergan has 20 days in which to respond to STAAR's complaint. The legal fees and costs associated with this litigation are not expected to have a material impact on earnings.
 STAAR Surgical Company, a publicly traded company founded in 1982, develops, manufactures and markets products for small incision ophthalmic surgery, primarily for use in cataract procedures. All of STAAR's primary products are approved by the FDA.
