SPECIAL MASTER RECOMMENDS UPHOLDING GERBER PATENTS AGAINST LECTRA AND AN
AWARD OF DAMAGES OF $3.2 MILLION
SOUTH WINDSOR, Conn., Dec. 18 /PRNewswire/ -- Gerber Scientific Inc. (NYSE: GRB) today issued the following:
The special master appointed by the U.S. District Court for the Northern District of Georgia to hear evidence on all the issues pertaining to Gerber patents in the case of Gerber Garment Technology, Inc. vs. Lectra Systems Inc. and Lectra Systemes, S.A. of France recently issued his formal recommendations to the court.
After hearing 15 days of trial testimony, the special master recommended that the court find that Lectra had infringed three separate Gerber patents dealing with Gerber's automated fabric cutting equipment called GERBERcutters(R). A fourth Gerber patent was found to be invalid.
In addition to recommending an award of damages to Gerber of $3,283,134 plus prejudgment interest, the special master further recommended that the court issue an injunction prohibiting Lectra from further infringement in the United States of Patent No. 3,955,458 which deals with the cutting head of automated fabric cutters.
"After five years of litigation it is gratifying to see that Gerber's position with respect to infringement by Lectra of Gerber patented technology has been recognized. Gerber will continue to vigorously assert its patent rights against infringers worldwide. We have already filed a formal motion for a temporary injunction against Lectra which will, if granted, prevent Lectra from selling several models of cutters in the United States," stated Fredric K. Rosen, the president of Gerber Garment Technology, Inc.
Gerber officials noted that the decision was a recommendation only, which is subject to review and approval by the trial court. Further, it should also be noted that both parties have previously requested a jury trial.
