SOLOFLEX SUED FOR FALSE AND MISLEADING ADVERTISING

 CHASKA, Minn., June 4 /PRNewswire/ -- NordicTrack, a Chaska manufacturer and distributor of fitness and wellness products, filed suit today against SoloFlex, Inc., an Oregon company. The suit was filed by NordicTrack in the United States District Court in Minneapolis to protect consumers from false and misleading advertising.
 "NordicTrack filed suit against Soloflex only after first pursuing other methods to solve our differences with Soloflex," said John Broeker, NordicTrack vice president and general counsel. "Back in April we sent a letter to Soloflex informing them that it is not NordicTrack's policy to pursue legal remedies against a competitor for false advertising without first giving the competitor an opportunity to explain or clarify its advertisements. Soloflex's response was to file a lawsuit against NordicTrack. We look at this as a preemptive strike taken by Soloflex in response to questions previously raised by NordicTrck regarding the truth of it advertising claims.
 "Given Sx?'s unwillingness to deal with NordicTrack outside the courtroom, NordicTrack had no choice but to take legal action," added Broeker. The company's complaint filed in Minnesota challenges Soloflex's advertising claims, which portray both the NordicFlex Gold(TM) and Soloflex(R) exercise machines in a false and misleading manner, thereby promoting confusion and deception among the consumers who purchase these machines.
 Soloflex not only makes untruthful, misleading and disparaging advertising claims about other in-home strength machines, it falsely asserts that negative resistance provides superior strength training to isokinetics.
 "There are many reports that refute this weak contention," said Jeff Zwiefel, director of the National Exercise For Life Institute. "One study conducted by the Institute of Rehabilitation Medicine, New York Medical Center, concluded that isokinetic exercise permits greater demands to be placed on muscular performance. Isokinetics also offer a means of developing greater power and endurance through loading the muscle capacity throughout the entire range of motion."
 NordicTrack seeks the court's assistance in requiring Soloflex to stop its false and misleading advertising campaign, and to correct the effects of Soloflex's previous advertising. In addition, NordicTrack will seek monetary reimbursement including punitive damages, for the losses it has suffered as a result of Soloflex's unfair and misleading advertising campaign.
 NordicTrack has also filed a motion in response to the Soloflex suit filed May 7 in Portland, Ore. against NordicTrack. NordicTrack is requesting the Oregon suit be moved to Minnesota and combined with NordicTrack's suit against Soloflex.
 "We are very hopeful that the courts will see that changing the venue for the Soloflex lawsuit to Minnesota and combining it with our lawsuit is a practical decision given the number of individuals that will be called to testify and the resources that are located in this state," said Broeker. "However, if the action stays in Oregon, NordicTrack is prepared to not only aggressively defend itself, but prove its allegations against Soloflex in any forum in the country, including Portland."
