SILICONE BREAST IMPLANT MAKER WINS FIRST DEFENSE VERDICT

SILICONE BREAST IMPLANT MAKER WINS FIRST DEFENSE VERDICT
 WAYNE, Pa., Aug. 18 /PRNewswire/ -- A 12-member Kealakekua, Hawaii,

jury on Aug. 17 found McGhan Medical Corp.'s silicone gel breast implants were defective and/or negligently designed but awarded no damages.
The jury found no causal link to the implant recipient's ailments and her implants.
The jury deliberated for six hours after four weeks of testimony.
"This is the first defense verdict for the implant manufacturers in a product liability action," according to Karen Storey, editor of Mealey's Litigation Report: Toxic Torts of Wayne, Pa., which tracks breast implant litigation throughout the country. There have been four multi-million dollar plaintiff verdicts and three settlements in implant cases thus far, Storey added.
Plaintiff Tina Craft underwent more than four operations due to her implants. One of her implants ruptured during a closed capsulotomy, which was replaced and again ruptured. Craft complained of fevers, headaches and general fatigue. However, she tested negative to a battery of rheumatoid tests.
McGhan argued at trial that Craft's ailments were caused by family stress, other medications and problems, not by her implants. According to Steven Brittain of Kailua-Kona, Hawaii, counsel for Craft, McGhan targeted this suit as a "test case" because it had the advantage. "Our location prevented us from bringing in many out-of-state witnesses and we did not have the subpoena power like federal courts," Brittain said. An appeal is expected.
