SEARLE FILES LAWSUIT TO STOP ALLEGED TRADE DRESS INFRINGEMENT
CHICAGO, Sept. 8 /PRNewswire/ -- On Friday, Sept. 4, Searle, maker of Calan SR(R), a calcium channel blocker for hypertension, filed an action in the Federal District Court in Newark, N.J., asking for an order to stop Goldline Laboratories and Baker Norton Pharmaceuticals from selling a generic version of Calan SR in a tablet with a similar shape and color as that of Calan SR.
Searle has requested that these companies voluntarily change their trade dress. "This action does not challenge the right of someone to produce a generic version of Calan SR," said Robert Bogomolny, Searle vice president and general counsel. "We are only asking that the manufacturers not market the product in a tablet that unfairly imitates the appearance of Calan SR."
Searle is a research-based pharmaceutical company that develops, manufactures, and markets prescription pharmaceuticals worldwide. It is a wholly owned subsidiary of Monsanto (NYSE: MTC).
