SC summons chairman NAB today to explain position in OGRA corruption scandal.

ISLAMABAD -- Justice Jawwad S Khawaja has remarked that NAB authorities are parading negligence deliberately to save the culprits in mega OGRA corruption scandal He further remarked " NAB has done nothing except seeking new date on every occasion. We cannot give more time. Chairman NAB was not there only for five months. But the sitting chairman who remained appointed for 21 months in his office also did nothing. This question is also very crucial that " if anyone other than chairman NAB cannot issue orders for inquiry. Even the court has no powers in this respect.

He observed " enough is enough, Chairman NAB will have to explain the whole matter now. Law does not say that chairman NAB should go on sleeping and if he is present even then no action is taken. NAB has not taken action against its officers so far. Punjab police, Motorway police and immigration authorities are also allegedly involved in the negligence and no action has been initiated against them.

Justice Jawwad S Khawaja gave these remarks while presiding over a 3-member bench of SC during the course of hearing of implementation of apex court verdict in OGRA former chairman Tauqir Sadiq case.

The court summoned chairman NAB today to explain the position in this case.

Justice Jawwad remarked " inquiry has been prolonged. So much time has been elapsed. What headway has been made.

KK Agha said " inquiry has been finalized and now the courts have to give decisions. Justice Jawwad observed " the court be informed what investigations have been made so far against Tauqir Sadiq. After interval KK Agha appeared before the court again and said " he had contacted the office. Shahid Sheikh is dealing this case who has gone to Karachi in connection with a course. Inquiry was started on November, 30, 2011. Information was collected from FIA in December, Notices were issued to Tauqir Sadiq in January, 2012 and witnesses were also summoned.

Justice Jawwad remarked " I have become much disturbed due to your talks. Prime Fasciae it is such a mega scandal. NAB is spoiling this case by dealing it in casual way. It is an ordinary case in your view while it is not like this. Study the November 25 decision. Case is now with prosecution and the concerned authority has not taken any decision with reference to this case so far no further chances of taking any decision are there.

KK Agha said matters have been finalized to considerable extent. This case has two aspects.

Justice Jawwad remarked " this has a third aspect too. Your office facilitated Tauqir Sadiq. How he proceeded to Dubai. What action you have taken against your men.

KK Agha said "investigations have two aspects. One is internal matter. Warrants were issued. Chairman has issued directives to finalize the matter as soon as possible. The other is external aspect which relates to Punjab police, embassy, staff, National Highway Authority and other institutions. Neutral investigation officers are working in this case.

Justice Jawwad remarked " 26 months have been elapsed that the decision was given. NAB had no chairman for 5 months. This period be deducted. No proceeding has been initiated in the reference during 21 months. We are now where we were on November, 25, 2011. No distance has been covered. If it could not be decided within 21 months who appointed Tauqir Sadiq, what happened inside NAB, Punjab police had indulged in what sort of negligence, then we may wait for 26 months more.

KK Agha said he has talked to chairman NAB and we will take decisions in such cases within two weeks.

Justice Jawwad remarked " the way you are working, it can take two years rather than two weeks. If there is any cogent explanation we can give two years. But no explanation has been given Law has empowered chairman NAB and if he does not take any decision then the matter will remain stalled. We will also close down the file.

KK Agha said " this case has taken much time. Please give 3 to 4 days more.

Justice Jawwad said " we are not preventing you from conducting investigation. Only tell us you have implemented which directive of the court. No judge among us is pleased with you. We are not ready to give you two to three weeks.

He remarked " the court be informed about the progress achieved after October. Court and NAB are travellers of same passage. W have to prevent corruption and illegal appointments. We don't want that corrupt people get chance to flee from the country.

KK Agha said " he be given two weeks and he will present final progress in this case.

Justice Jawwad remarked " we are giving you one day more to obtain directives.

The court ruled 26 months have been elapsed but court's orders have not been implemented. The case has 4 aspects. The first aspect is this that action has to be taken against those who were involved in the appointment of Tauqir Sadiq. The second aspect is this that action has to be taken against Tauqir Sadiq and other persons and Rs 82 billion have to be recovered from them. The third aspect of the case is the cases of those persons who facilitated Tauqir Sadiq to flee from the country and he escaped from the country. The forth aspect is the report on progress so far achieved in the matter. Action to be taken against the persons of NAB and outside NAB also is included therein.

Court ruled " if chairman NAB is not there or chairman does not take action then matters are becoming pending and this court has also no authority to do anything. This is the only question which is of paramount importance. The culprits get opportunity to be released in corruption cases due to these facts. Chairman is always chairman and if chairman does not act as per courts' orders then he is responsible for the entire matter. NAB should tell what action has been taken so far in this entire matter. Chairman NAB should appear before us in person and explain the matter.

The hearing of the case was adjourned till today.
