SANIFILL, INC. ANNOUNCES APPLICATION FOR HEARING ON NORM PERMIT; SETTLEMENT OF LAWSUIT AND SECOND QUARTER EARNINGS INDICATION

HOUSTON, July 12 /PRNewswire/ -- Sanifill, Inc. (NYSE: FIL) today announced that the permit recently issued to its Louisiana-based subsidiary, Campbell Wells Corporation, to treat nonhazardous oilfield wastes (NOW) containing naturally occurring radioactive material (NORM) is the subject of an application to the Louisiana Department of Environmental Quality ("DEQ"). The application requests a hearing to determine whether the DEQ correctly acted in its issuance of the permit. The company intends to intervene in the hearing process and believes the issuance of the permit will be affirmed, but there can be no assurance of the outcome.
The company also announced that it had reached agreement in principle with counsel for the plaintiffs and the class of persons represented thereby in the lawsuit styled "David A. Belman, et al. v. Alfred C. Warrington IV, et al." pending in the United States District Court for the Southern District of Texas, Houston Division. Final settlement of this action is subject to review and approval by the court.
Although the company believes that this suit is without merit, it has decided to settle the case to bring to an end the drain on management time and the defense costs, which have been significant over the past 18 months, and to avoid the uncertainty inherent in a trial by jury. The company expects to record an additional charge to earnings of approximately $.04 per share in the quarter ended June 30, 1993 to reflect the settlement. Prior to recording this charge, the company expected to report earnings per share of $.20 to $.21 for the quarter ended June 30, 1993. After recording the charge, the company expects to report earnings per share of $.16 to $.17 for the quarter ended June 30, 1993, as compared to $.15 per share for the quarter ended June 30, 1992. The company anticipates release of second quarter earnings on or about July 21, 1993.
Sanifill, Inc., headquartered in Houston, is an environmental services company specializing in nonhazardous waste disposal.
