Russian Federation : The court confirmed the legality of attracting the head of a rural settlement for the inappropriate use of agricultural land in the Lipetsk region.

In October 2018, the Office of the Rosselkhoznadzor in the Voronezh and Lipetsk regions conducted a planned on-site check of compliance with the requirements of the land legislation of the Russian Federation regarding the administration of a rural settlement of the Lomovsky village council of the Chaplyginsky municipal district of the Lipetsk region.

As a result of the inspection, it was established that on a land plot of agricultural purpose, on a fertile layer of soil of 5 hectares, production, consumption and other municipal waste was placed.

The height of the focal abiotic bed in this area is at least 0.41 m. The power of the abiotic bed is more than 40 cm, which indicates a fourth degree of soil degradation, characterized by the destruction of the soil cover.

There are no signs on the specified land plot banning dumping of garbage. Access to unauthorized dumping is unlimited.

Upon this violation an administrative protocol was drawn up under Part 2 of Article 8.7. Administrative Code.

In December 2018, the head of a rural settlement was found guilty of committing an administrative offense by a resolution of the Rosselkhoznadzor Department in the Voronezh and Lipetsk regions, she was sentenced to administrative punishment in the form of a fine of 60 thousand rubles.

Disagreeing with this decision, the head of the rural settlement of the Lomovsky village council appealed to the Chaplyginsky district court with a complaint about the annulment of the decision.

Having considered the evidence presented, in March 2019, the court decided to leave the decision of the Rosselkhoznadzor's Office unchanged, the complaint of the head of the rural settlement of the Lomovskiy Village Council was dismissed.
