REPUBLIC PICTURES DECLARES THAT FRANK CAPRA'S 'IT'S A WONDERFUL LIFE' IS NOT IN THE PUBLIC DOMAIN

LOS ANGELES, June 14 /PRNewswire/ -- Republic Pictures Corp. announced today that it has just completed the acquisition of exclusive rights to the copyrighted music in Frank Capra's classic film, "It's a Wonderful Life," that will allow Republic to preserve and protect the integrity of Capra's masterpiece. In addition to exclusive ownership of the copyrighted music within "It's a Wonderful Life," Republic is also the owner of the copyrighted short story upon which the movie was based. As a result, no company other than Republic Pictures is authorized to license the exploitation of "It's a Wonderful Life," stated Russell Goldsmith, chairman and chief executive officer.
According to Goldsmith, because the music and the short story are not in the public domain, no one can lawfully exploit "It's a Wonderful Life" without a license from Republic.
Republic acquired these exclusive music rights as a result of a series of transactions with Warner/Chappell Music, Irving Berlin Music Co., Edward B. Marks Music Co. and Shapiro, Bernstein & Co. Inc.
Noted copyright counsel James P. Tierney, who has been retained by Republic Pictures to protect its interests in "It's a Wonderful Life," explains that the failure of a company to timely renew the copyright of a motion picture based on copyrighted material would not result in the public at large having the right to exploit the picture. If the underlying material, a book, story or play, is copyrighted, anyone exploiting the movie would need a license from the author or current owner of the copyrighted material. It is well settled by the United States Supreme Court that the failure to renew a copyright for a film does not put any previously copyrighted materials in the film into the public domain.
"As the owner of the original negative for `It's a Wonderful Life,' we have taken these steps to protect this great American classic," said Goldsmith.
Republic intends to vigorously enforce its copyrights in the film and has been assured by each of the music publishers that they will support this effort.
The company will begin notifying television stations and home video distribution companies that the film cannot be exploited except with a license from Republic and will formally request them to cease selling or broadcasting unauthorized versions of the film.
First released in 1946, nominated for an Academy Award for Best Picture and included on the prestigious Library of Congress film heritage list, "It's a Wonderful Life," starring James Stewart, is arguably Capra's best and most representative work. Capra's films during this period conveyed a basic faith in the goodness of the common man and the triumph of honesty and justice over selfishness and deceit.
Republic Pictures Corp. is a producer and worldwide distributor of theatrical and television productions for its worldwide television, theatrical and home video distribution divisions. Republic is well-known for its extensive library of classic films, such as "The Quiet Man" and "High Noon," its Emmy-winning series "Beauty and the Beast" and such other popular off-network series as "Bonanza."
