RAMADA INTERNATIONAL SERVED WITH LAWSUIT BY MARRIOTT, HYATT AND HILTON

MIAMI, March 12 /PRNewswire/ -- Ramada International Hotels & Resorts has been served with a lawsuit by Marriott Corp., J.W. Marriott Jr., Hyatt Corp., Hilton Hotels Corp. and W. Barron Hilton, based on its current Renaissance Hotels & Resorts' advertising campaign.
The advertising campaign features three couples with the last names of Marriott, Hilton and Hyatt and accompanying tag lines, "Why the Marriotts (Hyatts, Hiltons) Stay at Renaissance."
Executives for Ramada International are shocked at the suit as they cannot see any legal basis for the 31-page complaint which alleges false and misleading advertising, unfair competition, service mark infringement, deceptive trade practices, injury to business reputation and violation of rights of privacy and publicity.
The ads contain testimonials by satisfied Renaissance customers and are an entirely legitimate form of advertising.
Any suggestion that the trademarks "Hyatt," "Marriott" or "Hilton" precludes all use by others of the same name, is unfounded. The registered mark is a surname shared by many people, all of whom have rights to use their own name.
The ads in question clearly show Renaissance to be the sponsor, and no reference is made to any affiliation or endorsement by Marriott, Hyatt or Hilton corporations.
A reasonable consumer is certainly not likely to believe that the plaintiffs are sponsoring or endorsing a direct competitor, such as Renaissance. This litigation shows very little faith on the part of the plaintiffs as to the intelligence of their consumers.
The Renaissance guest profile consists of discernng business travelers in upper management, who travel frequently and are not likely to be misled or deceived by these ads.
"We launched Renaissance Hotels & Resorts as a separate brand on Jan. 1 and it appears that Marriott, Hyatt and Hilton's real concern is with Renaissance's growing popularity in the luxury hotel market," said Erwin J. Rieck, Ramada International chief operating officer.
The Renaissance advertising campaign is legal and proper and the company firmly stands behind it.
Ramada International Hotels & Resorts features two lodging products: Renaissance Hotels & Resorts and Ramada International Hotels & Resorts in 40 countries.
All press inquiries should be directed to the company's North America/Latin America, Caribbean headquarters in Miami.
