QUOTRON EXPANDS ADP COPYRIGHT INFRINGEMENT SUIT TO INCLUDE
 SMITH BARNEY AS CO-DEFENDANT
NEW YORK, Dec. 6 /PRNewswire/ -- Quotron Systems, Inc. announced today that it intends to amend its copyright infringement complaint against Automatic Data Processing, Inc. (ADP) to include Smith Barney, Harris Upham & Co. as a defendant and contributory infringer.
The amended complaint alleges that Smith Barney helped ADP to obtain and make copies of Quotron's proprietary software to develop a Smith Barney pilot system.
In September, the tapes containing the alleged infringing materials were seized by federal marshals at the premises of Smith Barney's New York headquarters and ADP's New Jersey location. After a series of hearings, a federal judge entered an order of consent granting Quotron's request to have these materials reviewed by a team of independent technical experts. That team has already found examples of literal copying of extensive portions of Quotron's proprietary software. Once these experts have determined the full extent of infringement, Quotron will file for an injunction prohibiting ADP, Smith Barney or any other customer from utilizing any ADP system based on, or derived from, Quotron proprietary software.
The original complaint, filed against ADP in September 1991, alleged that ADP used Quotron's proprietary software to demonstrate the ADP pilot system at Smith Barney in an effort to induce them to convert to ADP. ADP has informed Quotron that it has abandoned the Smith Barney pilot system and has turned instead to developing a new system that will take approximately one year to deliver. Quotron believes that this action confirms its allegations that ADP was infringing its software copyrights to avoid the time and expense of undertaking ADP's own development effort.
