Poe's camp confident SET ruling extinguishes election offense pending at Comelec.

The camp of Senator Grace Poe-Llamanzares will move for the dismissal of the election offense case filed by lawyer Rizalito David before the Commission on Elections (Comelec).

Poe's legal counsel George Garcia, is referring to defeated senatorial candidate Rizalito David's complaint accusing the senator of "material misrepresentation" in the certificate of candidacy (COC) she filed in 2013 in the Comelec.

Garcia said the Senate Electoral Tribunal's ruling (SET) that junked his disqualification case against the independent presidential candidate effectively "extinguishes" the case.

He said they will file the motion on December 1, officially informing the Comelec of the favorable SET decision.

"We strongly believe that the SET win means there is no misrepresentation in the COC she filed when she ran for the Senate in 2013," Garcia said in a statement.
