Plywood and Composite Wood Products MACT Rule published.

On July 30, 2004 the EPA published the Plywood and Composite Wood Products MACT Rule. The rule requires 90 percent control of Hazardous Air Pollutants (HAP) or total hydrocarbons from regulated units at major HAP sources unless a facility demonstrates that it meets strict criteria for a risk-based exemption to the rule and EPA places the facility in a special low-risk subcategory. Initial notifications that the rule applies to a particular facility are required by January 26, 2005. Initial notifications are required for all major sources covered by the rule and must be filed with Regional EPA and State/Local permitting authorities, even if the facility expects to meet the risk-based requirements for exemption from the rule. For existing affected plants, the low-risk demonstration required for the risk-based exemption must be submitted to EPA by July 31, 2006. For existing facilities that do not use the risk-based exemption, compliance is required with one of the three compliance options by October 1, 2007. New facilities that began construction after January 9, 2003 had a September 28, 2004 compliance date. Initial performance tests and other compliance demonstrations must be performed within 180 days of the compliance date. Facilities are strongly encouraged to begin their planning and implementation efforts quickly since there are many requirements. Several environmental organizations have indicated that they plan to challenge EPA's establishment of a low risk subcategory for Plywood and Composite Wood Products sources. If that occurs, an industry effort to intervene in support of that aspect of the rule will be organized.
