 PUMPKIN LTD. FILES PATENT INFRINGEMENT SUIT AGAINST KMART
 DENVER, Oct. 5 /PRNewswire/ -- Pumpkin Ltd., the creator and


American manufacturer of the Carve-O-Lantern(R) Pumpkin Carving Kit, filed suit against Kmart today in the United States District Court for the District of Colorado. The suit alleges that the new "Make-A-Face Pumpkin Carving Set" made in China for Kmart violates Pumpkin Ltd.'s 1989 patent.
 "We created our pumpkin carving kit so we could share our 50-year family tradition with others," according to Kea Bardeen, president of Pumpkin Ltd. "We have worked hard to manufacture a quality product here in the United States. This year we were finally able to move the business out of the basement of our house and now it is sad to have to take on Kmart."
 In addition to the patent claim, the suit alleges the Kmart has unlawfully imitated the appearance of Carve-O-Lantern's package and that Kmart's product misleads consumers by failing to include patterns for the jack-o'-lanterns pictured on its package. "It really concerns me," said Bardeen, "that people might mistake Kmart's kit for ours and our reputation would suffer." The suit requests that Kmart be ordered to stop making and selling its "Make-A-Face" kit and pay monetary damages.
 BACKGROUND INFORMATION: PUMPKIN LTD.
 -- Pumpkin Ltd. is a family business incorporated in Colorado in
 1986 by John Bardeen.
 -- John Bardeen's father, Paul Bardeen, developed the original
 Bardeen pumpkin carving method and tools over 50 years ago.
 -- Kea Bardeen, John Bardeen's wife, has been Pumpkin Ltd.'s
 president since 1987.
 -- Pumpkin Ltd. currently has five full time and four part time
 employees. Its projected 1992 revenues are $2,000,000. Pumpkin
 Ltd.'s suppliers, many of which are also small businesses, are
 located in Colorado, Connecticut, Illinois and Missouri.
 -- Pumpkin Ltd.'s Halloween products are manufactured in the United
 States and include the Pumpkin Carving Kit, Zippy Carve Kit
 (containing easier patterns), Deluxe Pumpkin Carving Kit and
 Pumpkin Pals (three-dimensional pumpkin decorations), all
 marketed under the Carve-O-Lantern(R) name. Carve-O-Lantern's
 slogan, which appears on each product, is: "An American
 Product...By An American Family...For An American Tradition!"
 -- The Carve-O-Lantern Pumpkin Carving Kit retails for around
 $4.99; $3.99 at some stores. The kit contains two carving saws,
 one poker (to transfer the patterns), and one drill plus a
 24 page instruction booklet containing instructions and
 eight full-sized, ready-to-use patterns. Two bonus patterns are
 also included in this year's kit.
 -- Carve-O-Lantern products are sold nationally through mass
 merchandisers, craft, grocery and drug stores and through mail
 order catalogs. Some of Pumpkin Ltd.'s larger customers for the
 Carve-O-Lantern kit include Target, Frank's Nursery and Crafts
 and Michael's Craft Stores.
 -- Pumpkin Ltd. and/or the Bardeens have been featured on "CBS This
 Morning," "NBC Nightly News with Tom Brokaw," "Entertainment
 Tonight," and the "Home" show.
 -- Pumpkin Ltd.'s carved pumpkins have appeared on "Monday Night
 Football," "Roseanne," "Saturday Night Live," "Tonight Show with
 Johnny Carson," "Live with Regis and Kathy Lee," and the "Today"
 show.
 -- During this Halloween season, Pumpkin Ltd.'s carved pumpkins will
 be seen on "Family Matters," "Major Dad," "Roseanne," "General
 Hospital," and "CBS This Morning" (political pumpkins). Pumpkin
 Ltd. is also providing carved pumpkins for an upcoming Disney
 film, "Hocus Pocus."
 -- Pumpkin Ltd.'s community projects this Halloween include carved
 pumpkin displays at the Children's Museum of Denver and at the
 Norwest Bank Atrium in Denver. This will be the fourth year for
 both displays. Pumpkin Ltd. is also working with a local
 foundation to raise funds for the prevention and treatment of
 child abuse.
