PUBLISHER OBTAINS 'SMOKING GUN' WESTINGHOUSE DOCUMENT

    WAYNE, Pa., Feb. 22 /PRNewswire/ -- A 22-page in-house report which mentions several "potential smoking gun documents" at Westinghouse Electric Corp.'s (NYSE: WX) Industrial Hygiene Headquarters has been obtained and detailed in newsletters covering asbestos and toxic tort litigation published by Mealey Publications of Wayne.
    The report explains that "document retention and destruction programs" for Westinghouse "are imperative" because toxic tort litigation and toxic tort-related workmen's compensation litigation "show no signs of abating in the near future."  The report notes that legislation which was being considered by Congress could increase future toxic tort litigation.
    The report was published in its entirety in the most recent issues of Mealey's Litigation Reports:  Asbestos and Mealey's Litigation Reports:  Toxic Torts.
    A Texas trial judge, presiding over asbestos litigation, recently held that the document "describes a plan to commit fraud on the courts" of the nation.  On Feb. 16, the Texas Supreme Court rejected Westinghouse's appeal over the use of the document.  Westinghouse had asserted a claim of privilege regarding the document.
    Similar battles over the document currently are taking place in Mississippi, North Carolina and New Jersey, sources have told Mealey Publications.
    Mealey Publications also has obtained and published five related Westinghouse documents which refer to documents maintained at the Industrial Hygiene Department in Pittsburgh.  One of these documents, a Jan. 29, 1988, memo from the company's Industrial Hygiene Department, indicates implementation of recommendations included in the 22-page report.  The destruction of certain documents was among that report's recommendations.
