PRODUCTION OF LOOKALIKE DOLLS SOLD THROUGH SEARS CATALOG TO CEASE UNDER PERMANENT INJUNCTION GRANTED ASHTON-DRAKE GALLERIES

 CHICAGO, Feb. 16 /PRNewswire/ -- A federal court has granted The Ashton-Drake Galleries, a leading marketer of collectible porcelain dolls, a permanent injunction upholding and enforcing its copyrights in three original dolls: "Rock-a-Bye Baby," "My First Tooth" and "Mary, Mary Quite Contrary," it was announced today by Ashton-Drake.
 The injunction prohibits the manufacture, distribution, advertisement and sale of three other dolls sold through the Sears catalog which were copies of the Ashton-Drake dolls. The action was entered today as part of a settlement which recognizes Sears' unintentional participation in the copyright infringement.
 The infringing dolls -- called "Sweet Dreams," "Teething Time" and "Celeste," respectively -- appeared in Sears' 1992 Great American Wish Book. Sears purchased the dolls from the company that produced them: TCA Hong Kong, Ltd.
 The injunction is the result of a complaint filed by Ashton-Drake in U.S. District Court here on Jan. 13 against TCA Group of Natwick, Mass., which marketed the dolls, TCA Hong Kong Ltd. and Sears.
 The settlement requires the destruction within 60 days of all molds for the dolls in question, along with any unsold inventory. In addition, the defendants must provide Ashton-Drake with a complete explanation of how the infringement occurred.
 "We're pleased that the court has granted this injunction enforcing our exclusive ownership of copyrights for original dolls which were developed and marketed by Ashton-Drake," said Harvey C. Gordon, counsel for The Ashton-Drake Galleries. "We hope that this action will deter other parties from infringing upon and violating these rights in the future."
