 PNM ANNOUNCES HEARING EXAMINER'S RECOMMENDATION TO
 DECERTIFY PORTION OF SAN JUAN UNIT 4
 ALBUQUERQUE, N.M., May 12 /PRNewswire/ -- Yesterday, a hearing examiner recommended that the New Mexico Public Service Commission (Commission) decertify 50 MW of the 130 MW portion of San Juan Generating Station Unit 4 (Unit 4) previously excluded from Public Service Co. of New Mexico's (PNM) (NYSE: PNM) rates. If adopted by the Commission, this recommended decision would allow for the completion of a 50 MW asset sale of Unit 4 to the city of Anaheim, Calif.
 The recommendation partially approves a stipulated agreement negotiated in February between the company, the Commission staff, the Office of the New Mexico Attorney General, and the New Mexico Industrial Energy Consumers. That stipulation would have provided for decertification of the full 130 MW of Unit 4 excluded from rates. The hearing examiner recommended that at this time the stipulation be modified to allow decertification of only the 50 MW portion being sold to the city of Anaheim.
 The original stipulation also provided for a cap on the cost/kW of the next 130 MW of supply-side resource added before Dec. 31, 2002. That cap was originally set in February at the depreciated book value of Unit 4 at the time of the proposed in-service date plus $175/kW. The hearing examiner recommended raising the kW component from $175 to $248/kW.
 All parties to the original agreement must agree to the proposed changes if they are accepted and approved by the Commission. The parties also have the option of challenging those recommended modifications before the Commission prior to issuance of a final order.
