 NEW YORK, Nov. 9 /PRNewswire/ -- Phillips, Nizer, Benjamin, Krim & Ballon announced today that the firm's family law section has established a matrimonial arbitration service for attorneys and their clients.
 "The new service offers divorcing couples an important alternative to what often are costly, lengthy and complicated divorce litigations," said Julia Perles, the senior matrimonial attorney. She and fellow lawyer Patricia Ferrari will head up the service. Ms. Perles and Ms. Ferrari are among only 120 fellows of the American Academy of Matrimonial Lawyers, a group of divorce and family law attorneys elected by their peers, to be nationally recognized as matrimonial arbitrators in the past two years.
 Matrimonial arbitration is an alternative to litigation for divorcing couples. Each spouse, represented by an attorney, agrees in a written statement to submit any issues of controversy to a neutral third party, called an arbitrator. Unlike mediation, where the parties' attorneys need not be present and the mediators have no binding authority, the decision reached in arbitration is final, binding and enforceable.
 All issues involving child custody such as child support and visitation rights are subject to arbitration, except custody itself which is unenforceable as a matter of public policy. Matters such as property division and maintenance disputes, meanwhile, are the most common areas of arbitration.

"Unlike contested divorce proceedings which can often be quite expensive, time consuming and involve unwelcome public exposure, matrimonial arbitration is a relatively quick, cost-effective and private way to settle a divorce. Parties agree on a date, time and place for a hearing based on their schedules and needs and are not subject to court delays and continuances. Costs are also controlled by avoiding delays as well as by the informal and efficient disclosure and hearing procedures."

For matrimonial arbitration to be beneficial in resolving marital problems, the arbitrator must be exceptionally well versed in matrimonial law and possess highly specialized skills.
