Not holding LB polls in cantonments breach of constitution: SC.

ISLAMABAD -- Chief Justice of Pakistan Iftikhar Muhammad Chaudhry on Tuesday said not holding local bodies' elections in cantonment board areas was a violation of the constitution.

A Supreme Court bench was hearing a case about non-holding of local government polls in cantonments.

The three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry, had asked the defence secretary in previous hearing to appear and explain why the contempt proceedings should not be initiated against him for not complying with the court order.

The bench is hearing a petition, filed by former chairman cantonment board Quetta Raja Rab Nawaz's petition regarding elections in 34 cantonment board areas of the country. The petitioner has demanded that elections should be held in the cantonment areas of Quetta in accordance with the Local Government Act 1924.

The ministry of defence in its reply assured the court that elections in the cantonment areas will be held on December 15 this year.

The court demanded written guarantee of the Ministry of Law over the assurance made by the Defence Ministry.

In previous hearing, Attorney General of Pakistan Munir A. Malik had requested the bench to give some time to examine this issue

The chief justice observed that it was a sensitive issue and court order had been violated. He said that local government elections were not held in cantonment board areas for last 14 years.
