NO APPEAL IN WORLD'S FIRST EMF/CANCER CASE

SAN DIEGO, Oct. 7 /PRNewswire/ -- In April 1993, media representatives from around the world converged on San Diego Superior Court to cover the world's first court case involving the allegation that electric and magnetic fields (EMF) cause cancer. The following is an update on the Zuidema vs. San Diego Gas & Electric case:
The deadline has passed for an appeal in Zuidema vs. San Diego Gas & Electric, the world's first court case involving the allegation that electric and magnetic fields (EMF) cause cancer.
"No appeal was filed because there are simply no grounds upon which to challenge the fairness of the trial or the accuracy of the verdict," said Greg Barnes, assistant general counsel for SDG&E.
The verdict on SDG&E's behalf was issued April 30 after a jury deliberated just three-and-one-half hours. After a month-long trial involving the testimony of 13 expert witnesses, the jurors found that EMFs did not cause or promote five-year-old Mallory Zuidema's rare kidney cancer, nor did EMFs have a bearing on the property value of the Zuidemas' home. By rejecting the Zuidemas' nuisance claim, the jury also found that EMF did not cause any adverse health effects.
"The Zuidema verdict shows that 12 citizens who get to hear all of the science are not going to jump to conclusions about EMF and health effects," Barnes said. "This included the Scandinavian studies and the Swedish government's reaction to those studies."
In September, a motion for a new trial was rejected by Judge Judith Haller of San Diego Superior Court.
