NLC allowed oral argument in Omaha FLSA case.

The U.S. Court of Appeals for the Eighth Circuit recently granted a request by the City of Omaha and NLC to allow NLC to present oral argument in McDonnell v. City of Omaha. Although it is uncommon for an amici to present oral argument, NLC and an overwhelming majority of the state municipal leagues believe that the importance of the Fair Labor Standards Act overtime compensation issues raised in this case demand NLC's active and full participation.

Charles Cooper of the Washington, D.C. law firm of Shaw, Pittman, Potts & Trowbridge will present oral argument on behalf of NLC. In addition to his work on McDonnell and the State and Local Legal Center brief in Moreau v. Klevenhagen, Mr. Cooper will address other municipal litigation issues during the "Labor Mandate" workshop Monday afternoon from 2:00 - 4:00 p.m.
