NILES, MICH., MAN AWARDED $311,000 FOR LOSS OF THREE FINGERS

NILES, MICH., MAN AWARDED $311,000 FOR LOSS OF THREE FINGERS
GRAND RAPIDS, Mich., March 2 /PRNewswire/ -- A maintenance worker who lost parts of three fingers won a jury verdict of $311,000 in federal court here.
Ellsworth Cummins, a 57-year-old Niles, Mich., resident, was working at National-Standard Company's 11th Street plant when he tried to change the oil on a blower unit used in making wire.
His hand was caught in an unguarded hazard between a belt and a pulley on the machine manufactured by M-D Blowers, Inc. The defendant was Tuthill Corporation, which took over M-D Blowers.
The verdict of $415,000 was reduced by 25 percent on the jury's finding that Cummins was partially at fault for the injury, a net verdict of $311,000 plus interest and costs to be determined.
Paul R. Geary, of the Southfield law firm of Miller, Cohen, Martens, Ice & Geary, P.C., represented Cummins.
He said, "This was a grossly unsafe condition in the defendant's product, a serious defect. It's a fair verdict for a man whose ability to earn a living and enjoy life has been gravely affected."
