Monarch settles infringement suit

The Monarch Import Co. and Oak Beverage Distributing Co. of Texas announced that a settlement has been reached in an infringement lawsuit brought against Oak by Monarch.

In its lawsuit, Monarch charged that Oak had "knowingly and intentionally infringed" its Tsingtao beer trade dress. Specifically, the suit said the packaging and labeling of Oak's Laoshan beer was "misleadingly, and confusingly identical to the packaging and labeling of Tsingtao."

As part of the agreement reached, Oak agreed to a permanent injunction prohibiting it from copying or imitating Tsingtao's packaging. Oak also agreed to relabel all of its current inventory of Laoshan.
