This edition of jury instructions in employment litigation for employment law practitioners and judges better reflects the plaintiff's viewpoint. Notes follow each instruction, and the authors discuss relevant cases, whether plaintiffs and defendants disagree on it use, and how it might be modified. They do not incorporate standard form instructions for generalized burdens of proof, credibility of witnesses, or other background issues. Topics cover employment discrimination, the Equal Pay Act, wrongful discharge, intentional infliction of emotional distress and defamation claims, duty of fair representation claims, and the Fair Labor Standards Act. Chapters on the federal Family and Medical Leave Act and public employee claims are new. A CD-ROM of the jury instructions accompanies the book. Norton and Green are past co-chairs of the Employment and Labor Relations Law Committee of ABA Section of Litigation, which published this volume.
