Moat's texts on night of murder; Jurors told of messages sent before fatal shooting.

r ob.kennedy@ncjmedia.co.uk RAOUL Moat's alleged accomplice send a text to his girlfriend saying 'he is going to do it' the night before he gunned down his ex and killed her new lover. Karl Ness is accused of helping Moat during his gun rampage last year.

At the trial of Ness and coaccused Qhuram Awan, jurors were read a series of text messages sent between Moat, Ness and Moat's ex-girlfriend Samantha Stobbart before, during and after the shootings in Birtley, Gateshead.

In one, Ness says he has tried to 'reason with him' but 'he wants to end it'.

The text messages did not expand on who 'he' was and what he was going to do, but the next night Moat 'calmly executed' Chris Brown and shot Samantha Stobbart.

The text, sent at 5.51pm on July 1 from Ness to his girlfriend, Tara Collins, said: "He is going to do it. I tried reasoning but he has had enough and wants to end it. I tried but no joy." Phone records also showed Moat had been texting and calling Miss Stobbart repeatedly on July 2, between 10.49 in the morning and 12.41am the next day.Many of the calls were ignored, although Miss Stobbart did text Moat around 9.35pm on July 2 saying he had spoiled her mam's birthday by not picking up some puppies she had been looking after for him.

As Moat lay in wait for the couple outside a house on Scafell, Birtley, he was texting Ness, who prosecutors say was in the area and part of a conspiracy to kill Mr Brown. At 1.07am on July 3 Ness writes: "Well al miss u mate if it goes down."

Moat responds: "On (sic) problem mate. You're the best."

Moat goes on to say he can hear his targets and others 'slagging me off nice and proper' and adds menacingly: "Just watch, lol."

Around 2.02am Moat says: "Getting bored waiting. They are all slagging us off, my suffering is so funny apparently. Going to kick nice and proper when they come out. No wonder it's come to this. Six years mate, it's hard to listen to this coming from Sam."

Twenty minutes later Moat texts: "They have just opened the window so I'm tempted to lean in but I don't know whether it will open or not. What you reckon? Chance it or not?" Around eight minutes later the couple came out and Moat shot Mr Brown three times and then opened fire on Miss Stobbart through a living room window. Pathologist Dr William Lawler said two of Mr Brown's three wounds would have been fatal, pellets having passed through his heart and liver in one blast and his skull with another.

Ness, 26, of Brookside, Dudley, North Tyneside, and Awan, 23, of Rowley Street, Blyth, claim they were being held hostage by Moat at the time of the shooting spree and subsequent manhunt for him.

Ness denies murdering Mr Brown. Both defendants deny conspiracy to murder, the attempted murder of PC David Rathband, a firearms offence and the robbery of a fish and chip shop. The trial continues.
