Magistrate booked for beating petitioner to death.

A SUB- DIVISIONAL magistrate ( SDM) in Uttar Pradesh's Basti district has been booked for beating a 55- year- old man to death.

Shailendra Pandey alias Lallan had gone to the court of Santosh Vaishya in Sadar on Monday to get the release order for his motorcycle, which had been impounded by the police four days ago.

Lallan's family members said the police had seized his motorcycle and registered a case against him for trespassing, on the basis of a complaint by his neighbour.

Lallan's son Kaushalendra said his father had gone to the SDM's court to get his motorcycle released.

" My father used to pass through a road in front of our neighbour's house.

They had asked him to stop taking that route. I am told they are the SDM's relatives," Kaushalendra said.

He claimed that when Lallan went to meet the SDM, Vaishya suddenly turned angry and verbally abused him.

" When my father objected, he started thrashing him mercilessly.

There were more than 100 people present near the SDM's office and they saw the incident. I reached the court a few minutes before my father passed away. He must have received some internal injuries because he couldn't stand up," said Kaushalendra.

The incident took place around 5 pm and Lallan died an hour later outside the SDM's chamber.

" I don't know whether he died of shock or injuries," Lallan's son said.

An eyewitness said Vaishya has the habit of misbehaving and attacking people.

" He uses foul language in the courtroom and hurls files and shoes at those who appear before him. In fact, he expects bribe even before someone appears in his court and insults those who fail to understand his greed for money," the eyewitness alleged.

" Soon after Shailendra's death, we had confronted Vaishya and asked him why he had killed someone. But he said he had no idea about any such incident. Meanwhile, some policemen in charge of his security pushed us away and paved way for his escape," he added.

Janardan Tiwari, deputy inspector general of police, informed that a case of culpable homicide not amounting to murder has been registered against Vaishya.

" Irrespective of his position, he would be punished if found guilty," Tiwari said, adding that the SDM is absconding.

A panel of three doctors will conduct the postmortem on Lallan. Vaishya's colleagues, though, have sprung into action to save him.

Pankaj Kumar, district magistrate of Basti, said even though an inquiry has been ordered against Vaishya, " I am told that the SDM was not in his chamber at the time of the incident". It is learnt that chief minister Mayawati has asked her office to launch a probe into the incident and recommend necessary action against the SDM if he is found guilty of beating a petitioner to death.

On July 1, the police had arrested Barabanki SDM Ratibhan Verma and his wife Kialasha for killing their driver.
