MULTI-TECH FIGHTS HAYES ESCAPE SEQUENCE EDUCATION CAMPAIGN

MULTI-TECH FIGHTS HAYES ESCAPE SEQUENCE EDUCATION CAMPAIGN
ATLANTA, July 30 /PRNewswire/ -- Hayes announced today that after the close of business on July 29, it received an order from a court in Minneapolis in response to claims by Multi-Tech Systems, Inc. that Hayes' recent education campaign about modem escape sequences and the related Test Kit are causing Multi-Tech to lose sales.
According to the court's order, Multi-Tech claims "that if a computer user's modem is set to recognize the (TIES) escape sequence, Hayes' data file (contained in the Test Kit) will cause the modem to escape into command mode, the transmission of the data file will stop and the computer user will think that the modem is fatally flawed." The data file contained in the Test Kit offered as part of the Hayes education campaign is nothing more than ASCII characters which may occur in users' data. Any dependable escape sequence should ensure that the simple transmission of data will not cause the modem to abort a file transfer.
"I believe that TIES is not only a serious step backward for the industry, but also threatens the reliable transmission of data for business, government and other critical applications," said Hayes President Dennis C. Hayes. "We were surprised to learn that Multi-Tech had abandoned the proven, reliable escape sequence technology used in all Hayes modems since 1981 and has now incorporated the TIES escape sequence into its modems."
The court refused to stop Hayes advertisements which are a part of the education campaign. Those advertisements will continue to run through August, but the court, upon Multi-Tech's demand, did issue a 10- day order stopping distribution of the Test Kit. To protect Hayes, the court required Multi-Tech to post a bond to obtain the order temporarily halting distribution of the Test Kits. The court refused to grant Multi-Tech's request to extend the 10-day time period. Hayes has complied with the court order, and as a result of Multi-Tech's efforts, Hayes is unable to make the Test Kit data file offered in its education campaign available to the public at this time.
"We are happy that so many people have given us a very positive response to our attempts to inform the public about this problem. We hope to be able to continue this education campaign so that consumers can make an informed choice when purchasing modems," continued Hayes.
Best known as the leader in microcomputer modems, Hayes develops, supplies and supports computer communications equipment and software for personal computer and computer communications networks. The company distributes its products in over 60 countries through a global network of authorized distributors, dealers, VARs, systems integrators and original equipment manufacturers.
