MPSC SETS HEARING SCHEDULE FOR MCV SETTLEMENT PROPOSAL

MPSC SETS HEARING SCHEDULE FOR MCV SETTLEMENT PROPOSAL
JACKSON, Mich., Sept. 14 /PRNewswire/ -- Consumers Power Company

announced today that the Michigan Public Service Commission (MPSC) has commenced a proceeding to consider the previously announced revised settlement proposal which resolves all outstanding contract issues associated with the company's purchases of electricity from the Midland Cogeneration Venture. The proposal was originally filed by Consumers Power in July and revised by filings made on Sept. 8, 1992, at which time the staff of the MPSC reinstituted its support for the settlement proposal. The proposal is also supported by the developers of 13 independent cogeneration and small power projects. The MPSC set an expedited schedule which provides for filing of testimony by Sept. 25, commencement of hearings on Nov. 2, and for briefs and reply briefs to be filed on Jan. 29, 1993. The commission decided to read the record directly, thus avoiding the need for a proposal for decision by an administrative law judge. The MPSC stated that, upon filing of reply briefs, it could prepare and issue its final order.
Consumers Power Company, the principal subsidiary of CMS Energy Corporation (NYSE: CMS), is Michigan's largest utility serving almost 6 million of the state's 9 million residents in 67 of the 68 Lower Peninsula counties.
