MICRO TECHNOLOGY SCORES VICTORY IN GERMAN LITIGATION ANAHEIM, Calif., Dec. 6 /PRNewswire/ -- Micro Technology Inc.
today announced that the company has obtained its first victory in the German patent infringement suit brought about by Digital Equipment Corp. On Nov. 27, 1991, the District Court of Hamburg, Germany, Civil Chamber 15 unanimously ruled in favor of Micro Technology's request to have Digital's patent infringement suit stayed.
Digital filed the patent infringement suit against Micro Technology GmbH in July of this year. The suit claims that Micro Technology allegedly infringed on Digital's SDI and STI interface patents. Micro Technology filed a nullity action in Munich, Germany, against a Digital patent relating to this particular technology. The recent pronouncement from the Hamburg District Court states "the lawsuit shall be stayed until the court (in Munich) has decided on the nullity action concerning the German patent 32 68 033." Patent 32 68 033 is the first of the four patents pertaining to the suit, which concerns a coding of transmitted signals in SDI and STI technology. According to the court, "The proceedings shall be stayed in accordance with Section 148 of the Civil Procedure Code because, in the opinion of the Chamber, the success of the nullity action is likely to be expected." "The Hamburg ruling substantiates our position that the Digital lawsuit is completely without merit and reaffirms our view that the suit was initiated for marketing purposes," said Steve Hamerslag, Micro Technology's president and chief executive officer. "The Hamburg pronouncement also said, "...these claims cannot support the existence of Patent 1 (DEC) with approximately the same exclusive rights so that the nullity action should lead to success. The remaining claims of Patent 1 seem to suggest themselves and, therefore, are obviously not based on an inventive activity." "We are pleased that the Hamburg Court in its opinion has decided that Digital's patent is likely to be found invalid," continued Hamerslag. The nullity action will now proceed in Munich.
