 AUSTIN, Texas, Sept. 11 /PRNewswire/ -- MERCO Joint Venture announced today it has filed a motion in federal court to seek an injunction against Attorney General Dan Morales in its on-going battle with the Attorney General over the company's beneficial use project near Sierra Blanca in West Texas. MERCO claims, based on letters Morales recently sent to the Texas Water Commission, that the Attorney General is exerting improper political pressure on the TWC in an effort to circumvent Federal Judge Lucius Bunton's prior ruling denying Morales' request for a preliminary injunction.
 MERCO claims that the TWC's approval of the company's beneficial use registrations were based on science and the law -- not a political agenda. By joining TWC to the suit, MERCO seeks to enjoin the Attorney General from exerting the alleged political pressure on the agency. MERCO claims that Morales' actions are an improper effort to achieve through the "back door" what the state was unsuccessful in achieving at an earlier hearing on the matter.
 "The Attorney General's actions against MERCO set an ominous precedent against environmentally-sound alternatives for dealing with biosolids," said George Fore, MERCO's director of Ranching Operations.
 "It is most disturbing that Mr. Morales, based solely on the hope of political heroism, seeks to impede a productive, proven and environmentally-superior solution such as beneficial use; much less to deprive Sierra Blanca of the sorely needed jobs and positive economic impact the project provides," Fore added.
