MARVEL MOTION DENIED; DEFIANT'S WARRIORS OF PLASM HAVE DAY IN COURT

 NEW YORK, Sept. 30 /PRNewswire/ -- The motion by Marvel Comics Limited for a preliminary injunction in a lawsuit which sought to prevent rival DEFIANT from using the title WARRIORS OF PLASM(TM) was denied today in a ruling by Judge Michael B. Mukasey, U.S. District Court, Southern District in Manhattan.
 The lawsuit charging trademark infringement was filed in August by Marvel against DEFIANT, the six-month-old start-up comic brainchild of Jim Shooter. Marvel's suit maintained that the name WARRIORS OF PLASM infringed on its alleged trademark rights, first claimed in the United Kingdom for a character, Plasmer.
 Shooter, president and editor-in-chief of DEFIANT, said, "This is a clear cut vindication of our position in this case. We knew that we had not infringed upon their title. Obviously, we are thrilled with the judge's ruling."
 The first offering from Shooter's new company, WARRIORS OF PLASM No. 1, captured approximately 2 percent of the market in August.
