MARION MERRELL DOW RESOLVES ISSUE WITH STATES ON ADVERTISING COPY

 KANSAS CITY, Mo., June 9 /PRNewswire/ -- Marion Merrell Dow Inc. (NYSE: MKC) today announced that it has entered into a voluntary agreement with 12 states regarding the content of direct-to-consumer advertisements for two of its products. The company said its advertising already complies with direction from the U.S. Food and Drug Administration (FDA), which regulates promotion of pharmaceutical products. The company submits direct-to-consumer ads to the FDA prior to publication.
 Guidelines with respect to precautionary language have been negotiated by the company and the 12 states' attorneys general. The company said direct-to-consumer advertising of prescription drugs benefits consumers and the medical community by making people aware of the availability of important medications and by encouraging patients to consult with their physicians.
 Under the agreement, the company will pay each state's attorney fees and other costs. The company said it opted to resolve all issues rather than devote additional time and resources to litigation with the states. The agreement is with Arizona, California, Illinois, Iowa, Massachusetts, Minnesota, Missouri, New Mexico, New York, North Carolina, Texas and Wisconsin.
