LUBRIZOL FOUND TO INFRINGE EXXON PATENT

CLEVELAND, Dec. 24 /PRNewswire/ -- The Lubrizol Corporation (NYSE: LZ) has been found by jury verdict on Dec. 23 in Houston to infringe an Exxon (NYSE: XON) patent for an oil soluble copper additive component. The infringement suit was originally filed by Exxon in September 1989 in the United States District Court for the Southern District of Texas.
Terms and timing of any injunction have not been set. The additive component in dispute is used in small amounts in certain passenger car motor oil additive formulations sold in the United States. Lubrizol products made and sold in other countries will not be affected.
Lubrizol continues to believe that none of its products infringe the Exxon patent, and that the patent is invalid. Lubrizol will appeal the verdict to the Federal Court of Appeals in Washington, D.C. which reviews verdicts in patent cases. The issue of money damages will be addressed in a separate proceeding, as yet unscheduled.
Separately, on Dec. 4, the Federal Court of Appeals of Canada ruled for Lubrizol in its case against Exxon for infringement of Lubrizol's patent pertaining to dispersant, the largest additive component used in motor oils. The appeals court upheld the judgment in Lubrizol's favor following a two month trial in 1990. Damages in that case will also be determined later. Other cases related to the issues decided in Canada are pending in the United States and other countries.
The Lubrizol Corporation is a full service supplier of performance chemicals for lubricants and fuels to customers worldwide.
