LOWRANCE SETTLES LAWSUIT WITH TECHSONIC INDUSTRIES
TULSA, Okla., Nov. 27 /PRNewswire/ -- Lowrance Electronics

(NASDAQ: LEIX) announced today that it has settled its lawsuit against Techsonic Industries, Inc., manufacturer of the Humminbird Dimension 3 fish finder. The company, under the aegis of the United States Magistrate Judge, entered into a settlement with Techsonic on Nov. 22, 1991, two days prior to the scheduled jury trial in Tulsa, Okla.
In the suit, filed on Feb. 8, 1991 in the United States District Court for the Northern District of Oklahoma, Lowrance alleged that Techsonic printed advertisements and distributed video tapes relating to its Dimension 3 product that were false and deceptive and constituted violations of the Lanham Act, the Oklahoma Deceptive Trade Practice Act and common law unfair competition. On June 11, 1991, Techsonic Industries filed a counterclaim against Lowrance Electronics alleging that Lowrance's Eagle Challenge print ad and video campaign, which compared the on-the-water performance of the Eagle ULTRA and the Humminbird Dimension 3 under documented test conditions, were false and misleading and violated the Lanham Act and constituted unfair competition. Both companies sought injunctive relief and damages.
Details of the settlement are included in Lowrance's Form 8-K, filed with the Securities and Exchange Commission on Nov. 25, 1991. As part of the settlement, Lowrance received $400,000 from the Chubb Group of Insurance Companies and Techsonic agreed to a Consent Judgment prohibiting Techsonic from running its Humminbird Dimension 3 video tape and its Humminbird Dimension 3 advertising in magazine or newspaper print ads published, distributed, or used in the marketplace as of Nov. 23, 1991, and restricting Techsonic's use of Humminbird Dimension 3 boxes, catalogs and product brochures. In exchange, Lowrance agreed to stop running its Eagle Challenge video tape and advertisements.
"I'm pleased that we were able to favorably resolve this matter with a significant cash settlement, and several important concessions from Techsonic Industries regarding their future advertising and promotion of the Dimension 3," said Darrell Lowrance, company president. "Our primary interests in bringing this suit was to protect our customers from false and deceptive claims made about the performance of the Dimension 3, and to protect the credibility and reputation of our own Liquid Crystal Display (LCD) fish finders, including the Eagle ULTRA, which performed extremely well in the Eagle Challenge comparison. I'm confident we made significant progress toward those goals, and challenge all sonar manufactures to strive for fairness and accuracy when promoting the features and capabilities of fish finders," he added.
